If we suspect you’re misusing a badge

Council officers from the Parking and CCTV team are supported by Sutton's parking enforcement contractor and local police to undertake blue badge misuse operations across the Borough.

You may be asked to present your blue badge for inspection so we can assess whether it is being misused.

Our officers will:

  • always identify themselves and provide photo identification
  • inspect the badge and determine whether it is genuine and valid
  • check if the badge holder is present
  • use the National Blue Badge database to make further checks
  • have access to CCTV to verify details

If they suspect misuse they may confiscate the badge, using powers under sections 21 (4BA and (4D) of the Chronically Sick and Disabled Persons Act 1970 as amended by the Disabled Persons’ Parking Badges Act 2013. They can also conduct an interview under caution at the roadside.

If your badge is confiscated, we’ll return it to the issuing council. They will contact the badge holder.

Evidence will be reviewed and the person suspected of misuse (not the badge holder) may be prosecuted under Section 117 of the Road Traffic Regulation Act 1984 or Sections 1 and 2 of the Fraud Act 2006.
